It appears, based on the hearing itself, that many of the justices doubt that Texas (and joining states) lack legal standing to even bring the lawsuit into court. If they did, the justices asserted, every single time a state disagrees with a policy decision they could come to court and that cannot be how our system operates.

I believe and hope that the Supreme Court will actually decide the case on this standing issue to avoid having to make a political and policy statement regarding immigration, though the every-day effect of the case will be the same...the law will go into effect.
